#37-2023 Building and Maintenance Code Ordinance ADOPTED 11-14-23

Notice is hereby given that the Riley Township Board adopts Ordinance 37-2023 Building Code and Maintenance Ordinance text amendment to the Ordinances of Riley Township at a regular meeting held on November 14th, 2023.

The purpose of this ordinance amendment is to add text to incorporate the adoption of International Property Maintenance Code, 2021 Edition, as amended, as the Maintenance Code within the existing Building Code Ordinance; to add Ordinance Enforcement Officer to administer and enforcement of code; to add text to update ordinance title, purpose, additions and insertions of code provisions, availability of code for inspection; and to add/remove text to change penalty of violation from Misdemeanor to Municipal Civil Infraction with related fees, fines, sanctions and injunctive relief.

This Ordinance amendment shall take effect on the next day after this publication as required by law following adoption by the township board and shall remain in effect herein.

STATE OF MICHIGAN

RESOLUTION #2023 – 20

DECLARATION TO OPPOSE LEGISLATION TO PREEMPT OR OTHERWISE LIMIT LOCAL AUTHORITY OVER MATTERS OF ZONING OR LAND USE WITHIN RILEY TOWNSHIP

WHEREAS, members of the Michigan Legislature are proposing various bills to pass into law to preempt, or otherwise limit Riley Township’s local authority on zoning and land use matters that includes, but is not limited to, Short-Term Rentals, Sand and Gravel Mining Industrial Solar Installations, Industrial Wind Turbine Installations, and Battery Storage Facilities.

WHEREAS, the duly elected Trustees of Riley Township are best suited to receive public input in determining appropriate zoning and land uses that will specifically address the unique needs of Riley Township’s property owners, businesses and residents within its borders; and

WHEREAS, the duly elected Trustees of Riley Township are committed in protecting Riley Township’s property owners, businesses and residents from matters that may jeopardize the health, safety, and quality of life of the community.

NOW, THEREFORE, BE IT RESOLVED, the duly elected Trustees of Riley Township are opposed to any action taken by the Michigan Legislature that will preempt, remove, or otherwise limit Riley Township’s local authority over zoning or local land uses, that includes, but is not limited to, Short-Term Rentals, Sand and Gravel Mining, Industrial Solar Installations, Industrial Wind Turbine Installations, and Battery Storage Facilities; and

BE IT FURTHER RESOLVED, the Riley Township Board of Trustees are opposed to the construction, operation, maintenance, repair, replacement and decommissioning of Sand and Gravel Mines, Industrial Wind Facilities, Industrial Solar Facilities, Battery Storage Facilities, and other similar uses within Riley Township unless Special Land Use Approval is obtained in compliance with Riley Township’s duly adopted Regulatory and Zoning Ordinances; and

BE IT FURTHER RESOLVED, the Riley Township Board of Trustees support the longstanding right of the local community and its self-determination as provided by the laws and Constitution of the State of Michigan.

Motion made by DAWN BEHEM, seconded by AL TITUS to adopt the foregoing resolution.

The Supervisor declared the motion carried and the resolution duly adopted on the 10th day of October, 2023.

The purpose of this hearing is TO ACCEPT COMMENTS FROM THE PUBLIC on proposed amendment to Zoning Ordinance 33, Article IX, Section 919. Ponds.

The proposed ZONING ORDINANCE will be available for examination at the Township Office located at 13042 Belle River Road during regular business hours. Riley Township Zoning Ordinance, Proposed Zoning Ordinance Amendment, and zoning maps are available online at rileytownship.com.

The purpose of this hearing is TO ACCEPT COMMENTS FROM THE PUBLIC on proposed amendment to Zoning Ordinance 33, Article IX, Section 925. Small Personal Scale Solar and Utility Scale Solar Energy Facilities.
